1. Acceptance of Terms

By accessing or using the BookSmart website or mobile application (collectively, the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Platform.

2. Description of Service

BookSmart is a booking platform that connects customers with beauty and wellness professionals. Through our web and mobile applications, you can discover salons, browse services, book appointments, manage your bookings, and leave reviews. BookSmart acts as an intermediary and is not itself a provider of beauty services.

3. Account Registration

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activity that occurs under your account, whether on web or mobile.
• You must be at least 16 years of age to create an account.
• We reserve the right to suspend or terminate accounts that violate these Terms.

4. Bookings and Appointments

• When you book an appointment through BookSmart, you enter into a direct arrangement with the salon or service provider.
• BookSmart does not guarantee the availability, quality, or outcome of any service provided by third-party professionals.
• Cancellation and rescheduling policies are set by individual salons. Please review these before confirming a booking.
• Repeated no-shows or late cancellations may result in restrictions on your account.

5. Payments

Payments for services are processed through our third-party payment providers. By making a payment, you agree to the terms of the applicable payment processor. BookSmart is not responsible for payment processing errors caused by third-party providers. Refund policies are determined by individual salons unless otherwise stated.

6. User Conduct

You agree not to:

• Use the Platform for any unlawful purpose or in violation of any applicable laws.
• Submit false, misleading, or fraudulent booking requests or reviews.
• Harass, abuse, or threaten salon staff or other users of the Platform.
• Attempt to gain unauthorised access to any part of the Platform or its systems.
• Use automated scripts, bots, or scraping tools to access or collect data from the Platform.

7. Reviews and Content

By submitting reviews, ratings, or other content, you grant BookSmart a non-exclusive, royalty-free, worldwide licence to use, display, and distribute that content on the Platform. Reviews must be honest, relevant, and based on genuine experiences. We reserve the right to remove content that violates these Terms or is deemed inappropriate.

8. Intellectual Property

All content, features, and functionality of the Platform — including but not limited to text, graphics, logos, icons, and software — are owned by BookSmart or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.

9. Limitation of Liability

To the maximum extent permitted by law, BookSmart shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Platform. BookSmart's total liability for any claim shall not exceed the amount you paid to BookSmart in the twelve months preceding the claim. The Platform is provided "as is" and "as available" without warranties of any kind.

10. Indemnification

You agree to indemnify, defend, and hold harmless BookSmart, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses arising from your use of the Platform or your violation of these Terms.

11. Termination

We may suspend or terminate your access to the Platform at any time, with or without cause, and with or without notice. Upon termination, your right to use the Platform ceases immediately. Provisions that by their nature should survive termination shall remain in effect.

12. Changes to These Terms

BookSmart reserves the right to update or modify these Terms of Service at any time, at our sole discretion, without prior notice. Changes take effect immediately upon being posted to this page. It is your responsibility to review these Terms periodically for updates. Your continued use of the Platform after any changes constitutes your acceptance of the revised Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which BookSmart operates, without regard to its conflict of law provisions.
